This Agreement describes the terms and conditions under which the undersigned outside party (the “USER”) may use facilities owned by the Matthews Living History Farm Museum (the “MUSEM”).

Whereas the MUSEUM owns & operates, or lawfully controls the use of the property (“PROPERTY”) described below, and the USER desires to use said PROPERTY, the MUSEUM agrees to make said PROPERTY and no other available to USER at the date(s) and time(s) and for the purposes referenced below and no other, and in consideration for being permitted to use PROPERTY for the stated purposes, USER agrees to pay the fees and abide by the terms and conditions set out in this agreement.

Pavilion: Bathrooms and tables and chairs that are in the Pavilion.

Grounds: Can be used for parking but only in designated areas. You cannot go into pastures that have animals.

Price: $25.00 an hour + $50.00 deposit for events lasting 3 hours or less.  Events lasting greater than 3 hours the rate will be $50.00 an hour + $50.00 deposit.   

The $50.00 deposit will be refunded after your event if the facility is clean. Take your trash with you, do not leave it at the museum.  If you are scheduling during operating hours, be aware that others may be using the restrooms and may wander into the area.  If your event carries over after closing time at the museum, you will need to be finished by 10:00 p.m.  Someone from the museum staff will be onsite to lock up and refund the deposit at the end of the event.  If you need an extra day to clean up, it will result in another rental fee by the time that staff needs to be present ($25.00 an hour).

 1.   The USER agrees to pay the sums referenced above as a fee for the use of PROPERTY.   The deposit is due immediately.  The rest of the payment is due at the end of the event. Said payment includes use of utilities as may be needed for the purposes set out above and to the extent such exists at the PROPERTY.

 2.   DAMAGES and REPAIRS:  The USER agrees to be responsible for all damage to buildings, grounds, fields and equipment incident to the use of the PROPERTY.   USER shall make no temporary or permanent modifications to the PROPERTY without the prior written consent of the MUSEUM.

 3. PERSONAL: This agreement is personal, and the USER shall not assign this agreement nor allow any other person, group or entity to use the PROPERTY during the scheduled time(s) without the prior written consent of the MUSEUM. 

 4. TERMINATION: The MUSEUM may terminate this agreement at any time at its discretion.   If the MUSEUM terminates because USER has violated the terms of this agreement or because participants or attendees have violated laws, the USER is obligated to make full payment of all fees under this agreement.   Otherwise, termination by the MUSEUM shall result in a pro-rate refund of the applicable fee, based on the portion of the use period that was used but less expenses incurred by the MUSEUM.

 5. INDEMNIFICATION: The MUSEUM shall have no responsibility for the safety and/or security of any property belonging to the USER or to those people participating in the use of the PROPERTY by USER.  USER expressly releases and discharges the MUSEUM for all liabilities for any loss, injury, or damages to any such property and/or persons.

 6. WHOLE AGREEMENT: This writing contains the whole and complete agreement between the USER and the MUSEUM.

 7. The museum will post at the gate that a private event is taking place after closing hours. 

 8. If you wish to have alcohol for your event, you must present to the museum an ABC Event Certificate 3 days before your event. If one is not given to us and staff observe alcohol being served, we will ask you to leave and the agreement will be terminated at the fault of the User, which would mean, NO REFUND.
